Welcome to Solar & Scale. By accessing or using our websites, software, automated systems, or services (collectively "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Services.

1. Service Overview

Solar & Scale provides solar installation companies with software and automation solutions including, but not limited to, CRM infrastructure, lead response automation, missed call text-back, and AI-powered website chatbots. Solar & Scale is a technology provider, not a marketing agency guaranteeing lead volume or specific financial returns.

2. User Responsibilities & Compliance

TCPA Compliance: You explicitly agree that you are solely responsible for ensuring that all leads, contacts, and numbers inputted into the Solar & Scale system have provided the necessary express written consent to be contacted via automated SMS, MMS, and voice calls, as required by the Telephone Consumer Protection Act (TCPA) and other applicable federal, state, and local laws.

Solar & Scale provides the software infrastructure to send messages but assumes zero liability for your failure to obtain proper consumer consent. You agree to indemnify and hold Solar & Scale harmless from any claims, damages, or legal actions arising from your messaging practices.

3. Subscriptions and Payments

Recurring Billing: Our Services are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis (usually monthly). Your subscription will automatically renew under the exact same conditions unless you cancel it or Solar & Scale cancels it.

Refund Policy: We do not issue refunds for any partial-month subscription periods or unused services. If you cancel your subscription, you will retain access to the Service until the end of your current billing cycle.

4. Intellectual Property

The Service and its original content (excluding content provided by you), features, and functionality are and will remain the exclusive property of Solar & Scale and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Solar & Scale.

5. Limitation of Liability

In no event shall Solar & Scale, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use or alteration of your transmissions or content.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
